This Terms of Service covers all components of PhotoAi4you, including the PhotoAi4you_bot for Telegram, aiphoto.fi web-site, and API.

Welcome to PhotoAi4you. These Terms of Service ("Terms") govern your use of our PhotoAi4you AI image generation service ("Service"), including the "PhotoAi4you_bot" for Telegram, "aiphoto.fi" web-site, operated by Mirlan Dzhumagulov, based in Oulu, Finland ("we," "us," or "our").

By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you confirm you own the rights to any photos you upload and consent to AI-based processing.

2. Service Provided

The Service allows you to generate and edit images and videos using AI models provided by Google, including Gemini 2.5 Flash Image (“Nano Banana”), Google Imagen and Gemini Veo 3 for video. All generated images and video are AI-created and may contain visible or invisible watermarks.

3. Credits & Payments

You purchase credits via payment operatorPolar.sh. Credits are consumed when you generate or edit images. Credits are non-refundable once used. Refunds are handled under Polar’s policies.

4. User Responsibilities

• Do not upload sensitive images (medical, political, sexual, minors, or unlawful content).
• Do not upload or request edits of images you do not own or lack permission for.
• Do not use the Service for illegal, abusive, defamatory, or harmful purposes.
• Generated outputs are for lawful personal or commercial use.
• You may not upload or request generation of videos that contain or depict sensitive categories (sexual, violent, hateful, political figures, minors, illegal content). By uploading an image for video generation, you confirm you own the rights and consent to its use for AI processing.

5. Content Restrictions

You may not use the Service to:

• Create deepfakes of minors, celebrities, or political figures.
• Generate pornographic, hateful, or violent content.
• Violate intellectual property or privacy rights.

6. Ownership

You retain ownership of your generated images and videos. We do not claim rights over your outputs. However, we may use anonymized data to improve service quality (never raw user images).

7. Retention & Loss of Data

Outputs (images and videos) are stored for 30 days. After this period, they may be permanently deleted. You are responsible for saving your outputs locally; we cannot guarantee recovery after deletion.

8. Termination

We may suspend or terminate accounts that violate these Terms or our content policy.

9. Limitation of Liability

Service is provided “as is” without warranties. We are not liable for indirect, incidental, or consequential damages. We are not liable for data loss, downtime, or third-party service interruptions. Maximum liability is limited to the amount you paid for credits in the last 3 months.

Generated videos are AI-created and may not always be accurate, realistic, or appropriate for all purposes. We disclaim liability for misuse or reliance on generated videos.

10. Governing Law

Governed by Finland with jurisdiction in Oulu.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes means you accept the revised Terms.
